SECTION 153 OF, AND PARAGRAPH 3(1) and (7)(b) OF SCHEDULE 6 TO, THE PLANNING ACT 2008 REGULATION 56 OF THE INFRASTRUCTURE PLANNING (CHANGE TO, AND REVOCATION OF, DEVELOPMENT CONSENT ORDERS) REGULATIONS 2011 (AS AMENDED) NOTICE OF INTENTION TO CONSIDER MAKING A PROPOSED ORDER TO REVOKE THE A303 (AMESBURY TO BERWICK DOWN) DEVELOPMENT CONSENT ORDER 2023 (S.I. 2023/834) PLANNING INSPECTORATE REFERENCE: TR010025 NOTICE IS HEREBY GIVEN that the Secretary of State for Transport is proposing to exercise the power to make an order without an application being made as the Secretary of State is satisfied that there are exceptional circumstances that make it appropriate to exercise the power to revoke the A303 (Amesbury to Berwick Down) Development Consent Order 2023 (“the DCO”). Accordingly, the Secretary of State proposes to exercise the power to make an order to revoke the DCO (“the proposed order”). Summary of the Main Proposal The Secretary of State is considering making the proposed order to revoke the DCO which granted consent on 14 July 2023 to National Highways to undertake works for a new two-lane dual carriageway between Amesbury and Berwick Down. The proposed order does not involve EIA development (within the meaning given by regulation 3(1) of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2017).
